The Personal Injury Team

The personal injury team at Wallace & Wallace Lawyers Mackay is comprised of two partners, Brad Shanahan and Rohan Coburn and one Solicitor, Tamyka Gallagher.  The team are experts in accident compensation claims.

Brad Shanahan is an Accredited Specialist in Personal Injuries Law and has been practising as a solicitor acting for injured claimants for in excess of 25 years. Brad has been a partner of the firm since 1998. Brad is the only Accredited Specialist in Personal Injuries Law in the Mackay region and is also an accredited mediator, having undergone mediation skills training. Brad was admitted to the High Court of Australia in 1991 and is a member of the Australian Lawyers Alliance and the American Trial Lawyers Association.

Rohan Coburn was admitted as a solicitor of the Supreme Court of Queensland in 1994 and the High Court of Australia in 1999. He has practiced exclusively in personal injuries litigation for the last 16 years and has been a partner of the firm for some 10 years. He is a member of the Australian Lawyers Alliance.

Tamyka Gallagher was admitted as a solicitor of the Supreme Court of Queensland in 2017 and the High Court of Australia in 2018.  Tamyka has practiced predominantly in personal injuries litigation since this time.  She serves on the committee of the Mackay District Law Association, the North Queensland Law Association and is a member of the Australian Lawyers Alliance.

Personal Injury Services

Our services are not limited to Mackay and surrounding areas as we act for personal injury clients throughout the State of Queensland.  We also offer home visits (by negotiation) should the need arise.

If you have been involved in an accident you may be entitled to make a claim for compensation. Claims may involve monetary compensation and/or rehabilitation entitlements.

Rehabilitation Claims for Personal Injury

We are acutely aware of the need for injured claimants to fully access all entitlements to rehabilitation from treatment providers such as physiotherapists, orthopaedic surgeons, psychologists and, in some cases, neurologists and/or neurosurgeons. We are constantly liaising with the relevant insurers to ensure that our clients receive all required rehabilitation entitlements and reimbursement for any expenses incurred along the way.

The Workplace & Personal Injury

If you were injured at work and have paid someone to provide assistance with personal care tasks, household tasks or gardening/mowing since your injury, you are also entitled to claim for the costs of hiring someone to provide this assistance in the future (provided such care is required as a result of your injury).

If you received assistance with personal care, household tasks or gardening/mowing from family and friends without payment following your injury, you will not be entitled to claim for the cost of hiring someone to provide assistance in the future. This will be the case even if those family and friends are not able to or are unwilling to assist you in the future.

If you received assistance with personal care, household tasks or gardening/mowing from friends and family on occasion, but also paid someone to provide assistance with personal care, household tasks or gardening/mowing, you will be entitled to claim for the costs of hiring someone to provide assistance in the future (provided such care is required as a result of your injury).

Personal Injury Caused by Motor Vehicles/Car Accidents

If you were injured in a car accident you are entitled to claim the cost of hiring someone to provide assistance with personal care, household tasks or gardening/mowing in the future (provided the care is required as a result of your personal injury). If you have paid someone to assist you with personal care, household tasks or gardening/mowing since your injury, then you are more likely to recover the costs of any future assistance required.

Future Paid Care

Have you been injured in a car accident or a workplace accident in the last three years?

Have you been unable to complete personal care tasks (i.e. dressing, washing and toileting), your usual tasks around the home (i.e. housekeeping, cleaning, ironing, hanging out the washing and cooking) or gardening or mowing the lawn as a result of personal injury suffered at the workplace or in a car accident?

Have you had to pay for someone to provide assistance with personal care or to assist with tasks around the home or garden as a result of personal injury suffered at the workplace or in a car accident?

Are you likely to continue to require assistance with personal care or with tasks around the home or garden as a result of personal injury suffered at the workplace or in a car accident?

If you were injured at work or in a car accident and are no longer able to complete personal care tasks, household tasks or gardening/mowing as a result of your injury, you are entitled to claim the costs of hiring someone to provide this assistance. It is important that all receipts for such services are kept as these will be required to prove any past payments for assistance.

We can assist you in making a personal injury claim and recovering the costs of any paid assistance and should you be physically unable to attend our offices we are more than happy to arrange an in home visit to ensure your needs are met.
