Future Paid Care

Have you been injured in a motor vehicle accident or a workplace accident in the last three years?

Have you been unable to complete personal care tasks (i.e. dressing, washing and toileting), your usual tasks around the home (i.e. housekeeping, cleaning, ironing, hanging out the washing and cooking) or gardening or mowing the lawn as a result of a workplace injury or a motor vehicle injury?

Have you had to pay for someone to provide assistance with personal care or to assist with tasks around the home or garden as a result of a workplace injury or motor vehicle injury?

Are you likely to continue to require assistance with personal care or with tasks around the home or garden as a result of a workplace injury or motor vehicle injury?

If you were injured at work or in a motor vehicle accident and are no longer able to complete personal care tasks, household tasks or gardening/mowing as a result of your injury, you are entitled to claim the costs of hiring someone to provide this assistance. It is important that all receipts for such services are kept as these will be required to prove any past payments for assistance.

Workplace Injuries

If you were injured at work and have paid someone to provide assistance with personal care tasks, household tasks or gardening/mowing since your injury, you are also entitled to claim for the costs of hiring someone to provide this assistance in the future (provided such care is required as a result of your injury).

If you received assistance with personal care, household tasks or gardening/mowing from family and friends without payment following your injury, you will not be entitled to claim for the cost of hiring someone to provide assistance in the future. This will be the case even if those family and friends are not able to or are unwilling to assist you in the future.

If you received assistance with personal care, household tasks or gardening/mowing from friends and family on occasion, but also paid someone to provide assistance with personal care, household tasks or gardening/mowing, you will be entitled to claim for the costs of hiring someone to provide assistance in the future (provided such care is required as a result of your injury).

Motor Vehicle Injuries

If you were injured in a motor vehicle accident you are entitled to claim the cost of hiring someone to provide assistance with personal care, household tasks or gardening/mowing in the future (provided the care is required as a result of your injury). If you have paid someone to assist you with personal care, household tasks or gardening/mowing since your injury, then you are more likely recover the costs of any future assistance required.

How long do I have to make a claim?

Normally only 3 years from the date of the accident (this can be extended in some claims).

Will the claim go to court?

The majority of claims do not proceed to a court hearing. There are various pre-court steps and procedures that have to be undertaken which normally facilitate in the majority of claims settling at a compulsory conference.

Each claim is different because each client and situation is different.
